These Terms of Service (“Terms”) are a binding agreement between you and Safe Bite(“Safe Bite”, “we”, “us”, “our”) and govern your use of the Safe Bite mobile app and website (together, the “Service”). By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
IMPORTANT SAFETY NOTICE — PLEASE READ CAREFULLY
Safe Bite is an informational convenience tool only. It is NOT a food-safety, medical, allergy-management, or health device, and must never be relied upon to determine whether a product is safe for you to consume.
The Service can be wrong. It may produce false positives (indicating a product matches your dietary preferences, or is free of an ingredient or allergen, when it is not) and false negatives. Product, ingredient, and nutrition data comes from third-party sources, may be incomplete, outdated, mislabeled, or simply incorrect, and manufacturers can change formulations at any time without notice.
If you have a food allergy, intolerance, or any medical condition, do not rely on Safe Bite. Always read the full product label and packaging yourself, contact the manufacturer if in doubt, and consult a qualified medical professional. Never use the Service in an emergency. By using the Service, you knowingly and voluntarily assume all risks associated with relying on it, and you accept sole responsibility for what you choose to eat, buy, or avoid.
1. The Service
Safe Bite lets you scan food product barcodes and displays signals about whether a product appearsto match dietary preferences and restrictions you select, based on available third-party data. These signals are estimates for general information only and are not a guarantee of any product’s contents, suitability, or safety.
2. Eligibility and accounts
You must be at least 13 years old to use the Service. You are responsible for all activity under your account, for keeping your sign-in credentials secure, and for providing accurate information.
3. Acceptable use
- Do not misuse, disrupt, reverse-engineer, or attempt unauthorised access to the Service.
- Do not use the Service for any unlawful purpose.
- Do not scrape, copy, redistribute, or resell the Service or its data except as permitted by the underlying data licenses.
4. No reliance — your responsibility
You agree that you will not rely on the Service for any decision that could affect your health or safety, and that you are solely responsiblefor independently verifying every product’s ingredients and suitability by reading its label before consuming or purchasing it. You acknowledge that the Service is a starting point only and is not a substitute for your own judgment or professional advice.
5. Disclaimer of warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE AND ALL CONTENT AND DATA ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ACCURACY, COMPLETENESS, RELIABILITY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY INFORMATION IT PROVIDES IS ACCURATE OR CURRENT.
6. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL SAFE BITE OR ITS OWNERS, OPERATORS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY PERSONAL INJURY, ILLNESS, ALLERGIC REACTION, DEATH, LOSS, OR DAMAGE OF ANY KIND ARISING OUT OF OR RELATING TO YOUR USE OF — OR RELIANCE ON — THE SERVICE OR ANY INFORMATION IT PROVIDES, INCLUDING ANY FALSE POSITIVE OR FALSE NEGATIVE RESULT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US TO USE THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) US$100. Some jurisdictions do not allow certain exclusions or limitations, so some of the above may not apply to you; in that case our liability is limited to the smallest extent permitted by law.
7. Indemnification
You agree to defend, indemnify, and hold harmless Safe Bite and its owners, operators, and suppliers from and against any claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Service, your reliance on any result, your violation of these Terms, or your violation of any law or third-party right.
8. Data sources and third-party services
Product and nutrition information is derived from public databases, including Open Food Facts (Open Database License) and the U.S. Department of Agriculture (USDA). We are not responsible for, and make no warranty regarding, the accuracy of that data, and we are not affiliated with or endorsed by those sources. Your use of Google and Apple sign-in is governed by their respective terms.
9. Dispute resolution; binding arbitration; class-action waiver
Please read this section carefully — it affects your legal rights. Any dispute, claim, or controversy arising out of or relating to the Service or these Terms will be resolved exclusively by final and binding individual arbitration, rather than in court, administered under the rules of the American Arbitration Association. You and Safe Bite waive any right to a jury trial.
You and Safe Bite agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate more than one person’s claims or preside over any form of class proceeding.
10. Governing law
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules. Subject to the arbitration section above, any matter not subject to arbitration will be brought exclusively in the state or federal courts located in Delaware, and you consent to their jurisdiction.
11. Severability and entire agreement
If any provision of these Terms is held unenforceable, that provision will be limited or severed to the minimum extent necessary, and the remaining provisions will remain in full force. These Terms, together with our Privacy Policy, are the entire agreement between you and Safe Bite regarding the Service.
12. Changes
We may update these Terms from time to time. Continued use of the Service after changes take effect means you accept the updated Terms.
